The UFC Antitrust Lawsuit is actually moving. While we await the decision by the Ninth Circuit Court of Appeals on whether it will hear the UFC’s request to review the Class Cert Order by Judge Boulware, he has called a Status Conference to be held on Tuesday, October 31st in his Courtroom. No indications on what he will discuss but one might infer we will have some sort of resolution with battling law firms.

The Sparacino law firm has sought out to represent plaintiffs within the ‘bout class’ of fighters affected in the lawsuit but has been met with opposition by current Class Counsel. While Class Counsel has been appointed to lead the way in the lawsuit, the members of the class may choose their own lawyers for litigation, opt-out of the whole lawsuit or rely on the current Class Counsel.
Both law firms have retained experts to determine the ethical high ground in this dispute. However, both have smeared the other’s experts poking holes in their credibility and credentials.
The Sparacino law firm accused Class Counsel of intimidation and misrepresenting marketing materials it had sent to prospective clients. Class Counsel claims that Sparacino has misrepresented the current status of the case to potential members and has reached out to fighters already represented by Class Counsel. One would expect Judge Boulware to make a ruling on this on October 31st.
